H1b Applying again

Hi,

I got H1b for the period 2008 to 2011 August. But, due to the Recession, My client did not call me. So, I did not visit US. Not even one time.

Now my VISA expires on August 31, 2011. I am planning to apply again for next year.

Is it possible for me to apply again for next year ? thro' different company ?

Sure you can and if you are asked you can explain that the position was un available so you did not seek a VISA.

Any employer can petition for you and they may even claim exemption from cap and immediate starting date since you were cap-counted once. They will need a copy of the previous approval for this.
