Re-posting requirement for h1

Hi All,
My employer is willing to do my h1, but he says that according to his lawyer my job needs to re-posted in order to ensure that they cannot find a local employee that meets the requirements.

I was under the impression that this was only required if you are processing for a green card? Can anyone give me some information please?
