  • Short term in US need to filing tax

    I stayed in US between Jan 1 to Jun 18 2020. I got W2 for this period. I need to file tax in US. Am I considered as resident or non resident.

    Do I need to apply 1040 or 1040NR or Dual status.

    Please advise.

    If you hadn't been in the US in previous years, then you don't pass the Substantial Presence Test, and (assuming you are a nonimmigrant) are thus a nonresident alien. You would file 1040NR.

      Short-term capital gains are taxed as though they are ordinary income. Any income you receive from investments you held for less than a year must be included in your taxable income for that year.2 For example, if you have $80,000 in taxable income from your salary and $10,000 from short-term investments, your total taxable income is $90,000
