I am currently pursuing my PhD in a US university. I have a job offer from a company and would like them to file the H1B this year (2021). However I will not complete my degree until December of this year. I can apply for the masters quota as i have a master degree this year. My concern is that if my H1B gets picked, will it be a problem to obtaining the PhD degree if it is not completed by October 1st? I would like to add that i will be completing the degree requirements by October 1st, but because of the school deadlines, i would only graduate in December.

At the time of registration, it is not required that you will need your degree certificate.. But, Once your H1B gets picked up, at the time of filing, surely you will need to include your degree certificate.. If you have already done your masters in USA and University is Eligible for Masters quota then you need not worry about your PHD completion. With the completed degree you can move forward.
