Hi Experts,
My H1B will max out on 2 AUG 2021 and I have 35 days of recapture. Now my attorney is saying that if they apply for recapture days extension, I can get 240 days of work authorization after 2 AUG 2021. Please note, I don't have I140 approved, nor I have applied my PERM within 1 year of H1B max out. My PERM labor was applied on Mar 1st. Considering the current situation, I may not get my I140 approved before 2 AUG 2021.
Please let me know if that statement is true from my attorney and what options do I have.
