  • RFE on H1b transfer

    Hi,
    I got full time job with company.That company applied for H1b transfer and extension as my old h1 expires in october.There was an RFE.
    The RFE was about my w2 in last 2 years and the wages don't quiet reflect the wages in petition of my old h1.
    what should i explain for this thing in my response

    If you were out of status and not paid, force your employer to pay for the period as it is the law. Complain to DOL if needed.

    If you don't want to do it, consider yourself in deep trouble.

      I don't think USCIS will buy your excuse. Your W2 should match your approved LCA. If your employer paid you less than your prevailing wage, then you should complain to DOL and make they pay what was actually approved in the LCA. Probably you can respond to the RFE with a copy of the complaint to DOL. There is no concept of bench when you are in H1B.
