  • Is H1B Stamp Required ?

    Hello,

    I have H1 stamp till Apr 2011 from company A and I-94 is also till same date. Got laid off from A in 2009. Consulting firm B transferred my H1 successfully. After working for a year with B, I joined full time with C and they transferred my H1 some 2 months back. I am planning to visit India in Nov.
    1> Am I required to stamp again as changed my employers in between.
    2> If not, have anyone seen any issues at POE while returning back with new I797 approval and previous Co stamp.
    3> At POE if they ask me why do I left A, is it okay to tell them that I was laid off from A. Or, should I opt for some diff reason like got new opportunity.
    4> My H1 stamp is in prev expired passport and I renewed my passport a year back. I will carry both the passports. will there be any issue at POE with this.

    Thanks in advance for guidance.

    3. Why will they ask about A? They will ask about C. You should present current I797 from C at POE along with old visa/passport.

      1. As long as you have valid visa you don't require to go for stamping again. You can reenter on the same visa even if you work for another employer.
      2. Not an issue at POE. You can show the latest H1 approval
      3. Nothing harm in explaining the things if they ask.
      4. Not a problem. As long as you have valid visa even in expired passport it doesn't matter.
