  • Change of staus vs Consular petition

    Need some expert opinion here...

I am in US on L-1B and another company is filing my H-1B. They were filing a Change of status petition where on a specified day, I am supposed to start working for them without leaving the country. Because I have vacation plans and I didn't have precise start date at that point of time, I asked them to file consular petition so that I can serve my notice period in US, go to India on a vacation, get the stamping done and come back to join the new company.

I have been told recently that there has been an increase in rejections during the stamping process when consular petition route is used because there is no client letter, project details and things like that. Is it true and I should go for COS rather than Consular petition?

I don't know if matters but both the companies are among top IT consulting companies and I have degrees from very reputed institutes.

    Appreciate the response.
