  • Clarification on COS

    I am currently in L1, planning to move to H4/H1.

    In either case I assume I need to go for a COS.

    Do I have to wait until my COS gets approved or can I come out the L1 company as soon as my COS is submitted?

    If you apply COS from L1 to H4, then you can stop working immediately after filing the COS. But, if your COS to H4 gets denied and you no longer work for the L1 employer, then you will go out of status on L1.
    If you apply COS from L1 to H1B, then you should wait until the COS to H1B gets approved to work for the H1B employer. You should continue to work for the L1 employer to maintain the L1 status.

      Thanks Shervin. This really helps.

      One more clarification. Can I apply for a L1 to H4 COS, quit the L1 company, then before I get it approved can I apply for H1 COS?

      Or after applying for H4 COS, can I go out to a nearby country (Canada/Mexico) to get my H1 stamping?
