AOS from H-4

I'm here working with H-1B Visa, my family accomanying me with H-4 visa since last Feb.2010, thier i-94 will end in 30th nov.2010,
Now we applied for AOS for immigration upon employment as we were applied for that and our priority date was passed by the cut date, do my wife & kids need to extend thier H-4 status? our lawyer said that we don't have to ,as all will be in legal status once the application status for AOS is pending ,, but i'm still worried
plz. help
