Emergency travel to India

Hello,

I am an H1b and my six year tenure is getting over by March 17 2011. i had applied for my extension on october 4th along with my wife H4 extension. I have to go to India for an emergency trip, Visa is expired in my passport. so i go there i will get for five months or so.. What will happen to my extension which was applied on october 4.. is it safe to go to India now without my extension receipt or approval and just go to stamping using the old 797.

Please advise.

If it is not emergency then wait until you get your extension approval.
But if you can't wait, then if you have valid 797 till March 17 2011, then you will be getting the visa in your passport till that date. If you have all valid docs then nothing to worry.
