H1B expiring soon max6yr limit. GC application pending with 140,485 concurrent filing

  • H1B expiring soon max6yr limit. GC application pending with 140,485 concurrent filing

    My H1B expires in April 2011 and this is my max 6 year limit. Green Card application has been filed in Januray 2011 under EB1 with i-140 and i-485 concurrent filing. The current processing timelines on i-140 and i-485 show 4 months; I can only expect a decision by May 2011 in best case. In fact all i-140, i-485, i-765, i-131 applications are pending.
    Can I continue to stay and work even after my H1B has expired based on pending i-140/i-485? Can you please let me know my options?

    You should not stay past the I-94 expiry date unless an H1B extension is filed. You can get an extension for another 1 year based on your pending GC applications. Check this link.
