    Hi,

    I am currently on H4. One of the US company (X) is applied for the H1B petition for the year 2009 and got approved. I could not join the company. They revoke the petition.

    Now I have offer from other company(Y). I told them I have cap counted H1B. I have the copy of the approved petition. But I am not working since Feb 2010.

    My questions
    Is it possible for Y company to apply for the transfer using the same cap exempted petition? Is it possible to have H4-H1 COS?

    If yes, can I provide latest pay slips of Jan and Feb 2010?

    It is possible to get cap-counted H1 for you. You must have payslips for all the time you spent in H1 status. When and how did you change to H4 status?

      Thanks for the reply.
      I never worked on H1. I worked on L1 with Z company. So I can produce L1 pay stubs. I changes L1-H4 status change.

          Your new employer can file petition with change of status. They will need copy of your previous petition approval/receipt notice.
