  • H1 Transfer with F1 Visa

    Hi,

    Mine is a typical case. Employer A has filed my H1 in 2008 and it got approved but unfortunately my visa has been denied. In 2010, I reached USA on F1 visa. Now I am working for Employer B as an intern and he is ready to sponsor my H1B but there is no quota left for this year (both adavanced degree or general). The question I have is - is there a way that I can transfer my previous approved H1 which is still valid to Employer B? I haven't worked for Employer A at all and also I didn't arrive USA on H1B.

    Possible. Give a copy of that H1B approval notice to your new employer and ask them to file the petition using the CAP # from the old petition.

      The solution above is possible.

      Have you run out of OPT too? That's a good way to bridge the gap.
