  • H1B pending planning to exit and re enter to abandon COS

    I am planning to exit and re-enter the US to abandon my H-1B change of status (COS) so that I can keep working for my current employer. My previous employer applied for my H-1B and is not cooperative. Any advice or any have experience on traveling with a pending H-1B?

    PS: I have valid F1 visa for 2 more years.​

    Hi,
    Yes. At the time of adjudication, if you are out of country, then your COS request will be denied and it will approve under consular process. But please note, it is risk involved. sometimes, USCIS will approve with I-94. In this case, when you are out of country, you need to reenter with H1B visa stamping. Moreover, your SEVIS also will be deactivated the moment your H1B is approved. So please plan accordingly.
