Seeking clarification if i need to pay 1 lakh dollars according to my h1b petition

Hello Members,

I am new to this forum and seeking clarification.

I am currently based in India and have an H-1B petition approved in 2019. My visa stamping has expired, and I have never traveled to the USA under this petition.

I recently came across information regarding a possible USD 100,000 (1 lakh dollars) requirement under new rules. however, I would like to understand whether this applies to my case and how it may impact my petition status or any future plans to travel to the USA.

The $100,000 rule does not apply to your 2019 H-1B petition, as it only applies to new H-1B petitions filed after September 2025 for applicants outside the U.S. Your previously approved petition is not affected by this rule. However, since you have not traveled to the U.S. and your visa has expired, your old petition is likely no longer usable, so you may need a new H-1B in the future, and the rule could apply at that time.
