  • Banned /Restricted country H-1B cap-exempt not being considered

    I’m inside US on legal status and I’m from one of the most recent restricted countries. I received a job offer a few days ago but the hiring company just sent me this email :

    “Please note: we can proceed with filing for an H-1B Cap-Exempt petition and Green Card within 6 months of service ONLY if you are currently residing in the U.S.

    Kindly disregard this email if:

    you are not currently in the United States, or

    you are from any banned/restricted country list.

    Unfortunately, we will not be able to support candidates who are from banned countries, even if they are currently in the U.S.”​

    Are you from the 39 countries or the 75 countries?

      Hi,

      It is employer internal policy. I dont think it is USCIS rule. Please talk to Immigration Attorney for additional information.
