  • I-94 issue

    Recently My wife and kid traveled to India and returned back in December. By showing there I539 approval which is valid till march-2012 at immigration .

    In return my wife got I-94 till march-2012 and for
    My son immigration told that My Kid passport is going to expire on may 2011, so they gave him I94 only till may 2011.

    Now I got his new passport.
    Should I file for new I539 to get his I-94 ext ?

    You have 3 options

    1) File the extension (I-539) before your son's current I-94 expires.
    2) Try the local CBP post to see if they can extend the I-94 since you have got the passport extended (It may or may not work).
    3) Your son should leave the country before current I-94 expiry date and re-enter. He will get the extended I-94 upon his return.

      I-94 issue

      We stay 2 hrs far from chicago. actual POE is chicago.

      or we can we go to any CBP office near to us ? or we must only go to chicago office ?

        Chicago airport will be the closest. However, CBP may not correct the I-94 as there is no error on their end with the passport expiring soon. No harm trying.

          I-94 for Kid

          My kid has Approved I-539 till june 2012,

          Both he ahd his mom came to US on some day.

          Since his passport is near to expire ..POE gave I-94 base on his passport,

          last week got new passport


          Can CBP extend I-94 based on approval / Or

          I should apply for i539 extension again ?

            Well, you are asking the same question again. Like mentioned in the previous reply, your son got an I-94 with less duration because of his passport expiry date. It was not an error at POE. No one can predict whether CBP will help you extend the I-94 or not. There are cases where people have successfully extended the I-94 at a CBP post after renewing the passport (It totally depends on the officer you meet). You just need to try your luck. If that doesn't work, then file the extension immediately.

              In CBP site I see two type of location

              Should i go to Deffered Inspection location OR Port of Entry location

              pls giude

                I94 extension

                I called to Immigration, Chicago Air port .

                They told that i Have to go to USCIS office

                Will it work for getting new I94 based approval and my New passport.

                Or CBP is good place
