    A company filed for H1B for me in 2008 when I was on OPT. It was approved. But I didn't work for them and soon moved back to India. They didn't give me a copy of the I-797 to me.
    I am back now as a dependent. And want to apply for H1 through a different company. I want a copy of the I-797 now and have been contacting the company for more than a month and they are not responding. It does not look like they want to give me the I-797.
    According to the law, does the company have to give me a copy of the I-797? Is there anything I can do to make them give it to me.

    There is no such rule.
    But in order to use the previous cap number, all you need is the receipt number or a copy of the receipt notice.
