  • Urgent - H1 Transfer in 2nd term with I-140 approved

    Hi,
I work for company A and currently in my 2nd term of H1B Visa expiring on June 2012. My PERM and I-140 is approved and filed by company A. I have following question:

If company B is offering me a job and ready to transfer my H1B Visa, what would be the duration of that visa? Will approved I-140 helped me to get another extension with Company B? To get another extension what are the steps need to take by company B? Please let me know. This is urgent!

I appreciate your help....thanks in advance!

    Regards,
    Someone in need!

With the copy of the I-140, company B can file the transfer and request a 3 year extension. Company A should not have revoked the I-140 when the transfer is in progress. You will need to restart the GC process again with Company B to request further extension (Labor should be filed 365 days prior to your I-94 expiry date). However the current priority date can be retained.
