  • H1B Amendment Question

    Hi I have a question regarding my H1B Petition and Stamping.

    1) Got a H1B petition approved from my current employer on Jan 2010.
    2) Petition Expiry date is Dec 2012.
    3) Travelled to Canada before the H1 Approved petition could arrive because the project was not signed at the last moment.

    Questions:

    1) Can I use the H1B Petition to get my H1B Stamping for a different project?
    2) IF not should it be amended?
    3) IF its amended will the petition validity remain as Dec 2012 or will it change?
    4) Also roughly how long would it take for the amendment process?
    5) Is there any risk of the H1B Amendment getting rejected?

    Will you be working at a new location (Different from the one on your LCA and petition)? Is your employer a consultancy company who places you at the client location for work?

      Its not a Consultancy....I work for a MNC in India.

      It will be a new location....

      One more question...If its the same location I don;t need a Amendment? bcos i don't have a stamping for tht petition yet...and the petition was approved on jan 2010.

        If you are going to work on the location for which your LCA is filed, then you are good. Otherwise, you will need a new LCA and an H1B amendment. H1B amendment will take 2-3 months to get approved.
