  • H4 to H1 COS

    Hi All,

    Here is my situation

    I got my H1B in oct 2008. I worked for an year and changed my status to H4 in dec 2009 as I didn't get a project. I'm currently on H4 status. My 1st three years of H1b will expire on Oct 2011.

    Here are my questions

    1) Will my H1b cancels after Oct 2011?

    2) When I get a project after Oct 2011, do I need to file a new H1b? or can I just file a COS then and have my H1B extended?

    Quick reply would be appreciated..

    Thanks in advance

    >>> No.

    >>> You can file a COS. The COS will come with an extension. H1B (+ L1) in total is for 6 years and it includes only the tome spend in U.S in H1B or L1 status.
