  • Lost old I-94 during passport renewal

    I had sent my daughter's passport for renewal to NY consulate. Unfortunately, in the passport I forgot to attach the I-94 extension that she had received when her visa was converted to H4 from L2 during her stay in US. The old I-94 that was attached to the passport was valid till 2010. When I received the old passport, the old I-94 wasnt attached. Does my daughter need that to go to India for a visit this summer? Will having the new I-94 only help?

    Technically, you are suppose to return all the I-94's when you leave the country. Otherwise there won't be a proper exit entry against that I-94. If the I-94 doesn't have amatching extension or if it was not returned back to USCIS, then it will show as if you have overstayed and have accumulated illegal stay.

    Do you have a copy of the old I-94. Check if the new I-94 number is same as the old expired one. If yes, then I guess you are okay.
