My spouse is currently in H4 Visa. Previously she was in H1 and her H1 Petition was valid till March 2012. She wants to work again. Can she apply for H1 transfer or does she have to apply for new H1?.

In case of H1 transfer, what documents should she need to provide?

>>> The employer can file a COS from H4 to H1B using the CAP from the previous H1B approval notice (Give the employer the copy of the previous H1B approval notice) and request an immediate start date. Upon approval of the petition (With a new I-94) she can start working for the employer who sponsored the petition.
