  • H1b transfer

    Hi , My case -

    H1b stamped - Nov 2010
Worked for company A in US from Dec 2010 to MAR 2011 .Project completed and company A moved me back to India .

Transferred H1b through consular processing and started working for company B from April end . Now I have 4 payslips thru company B .

Now I have a great offer from company C which is huge IT company .
Can i transfer H1b with 4 payslips or should I wait for one more month ?

    Thanks

    >>> If company A moved you back to India, are you saying that you went back to U.S later to work for Company B?

    >>> Is this employment in India or U.S? If it is in U.S, did you exit the country and reentered with Company B's approval notice?

Now I have a great offer from company C which is huge IT company .

As long as you have pay slips to prove that you maintained your H1B status right from the day you entered U.S, you can successfully transfer the H1B to a new employer. Usually latest 2-3 months of payslips are enough to transfer the H1B. it is advisable you join the new employer only after a successful H1B transfer rather than on the receipt notice.

You can apply now. However some employers will ask for at least the latest 3 months of pay slips to be more comfortable with the transfer. It depends on the employer.
