H1 renewal - 240 + days

  • H1 renewal - 240 + days

    I have a H1 whose renewal I applied in Aug'10, I94 expired on 25th Oct'10, RFE raised Feb'11, responded Apr'11, now I'm more than 240 day's past, not sure from what date should I count also need to know as of today what is my
    1- Legal status to stay in US,
    2- Legal status to work in US,
    3- Would applying for premium processing be an option after 240 days while staying in US.

    If the extension gets denied, then all the time spent in U.S after the I-94 expiry date will be treated as illegal stay. It was wrong of you to wait this lo0ng without upgrading to premium to avoid unnecessary risk. You can upgrade to premium now.
