H1 B Staying outside USA and getting Paid

Hi,

I am currently on H1B and my VISA has been stamped and is valid till Oct 2012. I had to come back to India due to my father's health and am not sure for how long will I have to stay here. It might take a couple of months for him to recover. Is it legal for me to work from India and be on US payroll? If yes, is there a limit on the amount of time I can do this after which I have to return to USA? My employer is concerned if he will be violating any LCA agreements if he pays me while I am in India. Please help me in this regard.

Once you are outside the US, it does not matter. You can work and get paid. Your employer can consult an experienced lawyer if they want confirmation.
