  • Time taken to do H1B in premium

    Hello Friends,
The company lawyer told me that it will take 3-4 weeks to do the H1B transfer + extension in premium. I was surprised because I thought that it should only take 15 days. She told me that the LCA will take a week to do. Only after LCA can they apply for transfer + extension and then it will 15 days. Is this right that it will take 3-4 weeks. One of my friends said that his H1B transfer was done in 15 days and never mentioned anything about LCA. Is LCA an extra step that this company is doing?

Your lawyer is right. H1B petition cannot be filed without a valid LCA. LCA will take anywhere between a week to 10 days to get approved. The H1B petition need to be filed with a copy of the approved LCA. From the date on which USCIS received your documents (date of receipt notice), it will take up to 15 days to get the decision.
