  • H1B transfer & 6year limit

    I am in the 5th year of my H1B with current employer. If I change to a new employer and they file for a new H1B (transfer=new cap exempt H1B) will the new H1B visa with the new employer be for 3 more years or just one more year. Does this make me eligible for another 3 year extension even though my green card application has not been filed for?

    Each H1B CAP is valid only for 6 years. You are not eligible for a fresh new H1B term until you spend 1 whole year outside U.S. If you transfer your H1B now, you will only get 6 years minus what ever time that you have already spent in H1B + L1 combined.
