  • Need Help..

    Hi,

I would really appreciate some help here. My employment ended at the consulting company I was working with on July 08 2011. My employer has filed to revoke my H1b at USCIS on July 08 2011. I have my paystubs till July 08 2011 and my H1b is valid till Oct 2013. I have been giving interviews and looks like I might get an offer soon. Would I still be able to file for a new H1b visa by a new employer considering I do not have paystubs since July 08 2011 after my employment ended with my previous employer?

    Thanks!

The transfer might not get approved without the latest payslips, considering the fact that you are currently out of status on H1B. Even if the transfer gets approved, the chances are that it might get approved for a consular process (without a new I-94). In such case, you need to leave the country and return back with the approved petition and a valid H1B visa to start working for the sponsor.
