I currently have an H1B petition approved with the current employer till 2013 end (with I-94 issued). About 2.5 years back an H1 transfer for me was denied from Employer A to B, I had already started working for employer B on portability and worked for him for 4 months till transfer was denied. I found another employer C and started working for them exactly after one month(visa transfer was approved for employer C and new I-94 was issued). Now I want to visit India and have to go for stamping as current visa stamp has expired. I wanted to know if its OK to show this one month of gap in employment in visa interview form DS-160, how could that adversely affect my chances for getting visa stamped.
Note: Employer B paid me a severance pay for 1 month (Taxes paid) and filed an MTR within one months time which was also approved and visa granted with I-94. Although I never worked for him again.
