  • H1B Visa Extension stamping question

    Hi, currently i am in US holding H1B visa and stamping till Dec28,2011. I applied for H1B Extension and it has been approved. I am planning to go for stamping to Tijuana, Mexico in Nov2011. My question is, if my visa is rejected for some reason, can i re-enter US with my Old Visa Stamping, Old I797? If they reject my New petition does it mean they rejected all my petitions i.e old H1b and Old Visa stamping?

    You can re-enter as long as the old visa is not cancelled during you visa stamping. In most cases the first thing that will happen is cancel the old visa with a "CWOP" stamp and then decide whether to issue a new visa or not.

      Do you know if they have any rule for them to cancel my old Visa ? or is it upto the VO officer who is interviewing me?

        It is up to the VO. In most cases they follow this.
