    Hi All,

    I have received I-797B document on Oct, 2008 and it was valid till March 2011. My employer was not able to find any client for me during these years and now it has been expired. H1-B stamping is still to be done. I am currently in India and talking with a US company who is looking to process H1-B for me. Please advice me on the following:

    1. How to renew I-797B and who will renew this? Will it be a new petition by the new company?

    2. I have n't received H1-B (not even applied) as of now. Will my new company need to file any H1-B transfer case?

    Please have a look at my case and reply so that i can go ahead with the processing.

    Any employer can file a new H1B petition for you using the CAP from your previous H1B petition and request an immediate start date. Give the new employer a copy of your previous H1B approval notice. Once the petition gets approved, you can attend the H1B visa stamping and when the visa gets approved you can travel to U.S to work for the employer.
