    Dear Shervin ,

    Information :

    1 ) 2006 - 2009 : Granted H1b

    2009 - 2012 : Applied for FIRST renewal , Approved.

    Came to India for Stamping && under Administrative Processing

    2 ) Outside US for a Year since under Admin.Process ( Pink )

    3 ) 140 already approved

    4 ) Need to apply for Second renewal ( 2012 -2015 ) residing
    outside US

    Will there be any issues regarding renewal outside US...?

    There will be no issues as long as the documents are in order. Since you have stayed outside U.S for 1 whole year, if you file a new H1B on a new CAP (apply on or after April 1st with a Oct 1st start date) you will get a fresh 6 year term in H1B. But since your I-140 is approved you are eligible to keep apply extension after the end of the 6th year.

      1) Do you mean that I can file H1b renewal with this I-140 before expiry date ( May 2012)...?

      2) If my Administrative Processing got over by December or January 2012 can I apply for h1b renewal entering US...?

      3) Since am outside US does !-94 require for h1b renewal...?

        >>> I-140 will help in filing the extension beyond the 6th year. Once you complete the 1st 6 years in your H1B CAP, you can use the I-140 to file the 7th year extension. Only the time spend in U.S in H1B + L1 status counts against the 6 year limit.

          Is there any deadline date for filing h1b renewal ( My h1b expire May 2012 ) outside US..?

              There is no deadline. All that you will be doing is filing a new petition using the old CAP and it can be done anytime.

                Dear Shervin ,

                I am on AP 221g Pink slip for the past 1 year...
                We contacted consulate and DOS several times..the answer is " Still Pending"
                So my company attorney mailed LEGELNET - no reply
                Sent 2 congressional enquiries - no reply
                sent 3rd congressional enquiry... USCIS responded they need some docs..
                when contacted by US Cong.office in India(consulate) they said no docs needed but " still AP " and will let applicant know when process is done..
                the waitin' hurts a lot..
                Any other measures that i can do..?

                  Find a new employer and transfer your H1B. When approved, apply for H1B again.
