  • Original H1B approval notice - Must an employer provide this to the employee

    Hi,

    New year greetings to All.

Is it must that an employer maintains courtesy copy of an H1B approval notice in the organisation and provides the original approval notice to the employee?

    Please let me know.

    Thank you in advance

If the approval notice includes a change/extension of status (I-94 at the bottom), at least the bottom part must be given to the employee.
If the petition was filed as consular processing (no I-94), then the approval notice needs to be given to the employee only when employee applies for a Visa at an embassy/consulate abroad.
This is my opinion and not legal advice.

      Thank you Sir.

If the prospective employee is outside US and the H1 was filed for the 1st time and got approved, then in this case, the employer has to provide the original I 94 to him for stamping purpose - rite? Can you please confirm.

      Thank you once again.

Yes, that is correct. But if the employer does not want the employee to join immediately they are not obligated to provide the approval notice to the employee.
