  • H1 B extension after 6 years : Labor approved

    Hi,
    I am about to complete 6 years on H1 B by mid Jan 2012. However, my I-797 is valid till May 26 , 2012. Meanwhile, I have been informed by my employer that my Labor is approved (on Nov 28,2011) . The I-140 is not yet filed. Can I stay beyond mid Jan 2012 ? What are my options for staying beyond expiry of 6 years?

    Was your labor filed 365 days prior to the end of the 6 year term? You need the 7th year extension to be filed based on the labor, if filed 365 days before the 6th year end or you should have both the labor and I-140 approved to file the 7th year extension. I-140 can be filed in premium to get a result within 15 days.
