** H1B to L1A COS Query **

Hi,

I am on H1B in US and my visa is expiring in 6 months. I will be completing my 6 years, so it cannot be extended furthere.

Can my company apply for COS from H1B to L1A?

It would be great if someone can give reference to USCIS site where it is mentioned that this can be done.

** H1B to L1A COS Query **

For fresh L1A amongst the other criteria you should have been working as Manager abroad in the Organization's subsidiary for at elast 1 Year in th eprior 3 years. If you have been in US for last 6 years I dont know how you will qualify for L1. L1 Visas are for bringing on people from one of its affiliated foreign offices to one of its offices in the United States. Its not intended for within US transfers. This is my opinion, do consult experts too.

H1B + L1 in total is for 6 years. A change of status from H1B to L1A is not possible in your case.
