My employer missed to file LCA with DOL on time and we are sure to miss the last date of my H1 visa/I94 to file extension. I will be out of status and will not be able to work until I get my visa approved. My employer will file H1 & H4 visa extensions in premium and will also submit NPT application so that we get backdated I-94.
I want to know if anyone has gone through similar process and what are the chances to get the I-94 backdated. If not how does this impact GC processing?
