  • H1-B cancelled without prejuidice

    Hi All,

    I had a H1-B visa which was valid till august 2011 ( valid from march 2011) and I could not file for an extension and it got expired. My company has filed for a L1-B in december 2011; I got rejected in march 2012.

    The counsellor has put a stamp on my H1-B "Cancelled without prejudice". Does this mean I cannot re-open ( file under cap-exemption) this H1-B Visa.
    Also, how soon a visa can be filed again after rejection.

    Please throw some light on this.

    >>> Only the visa is cancelled. If the petition is still valid and if the job still exist, then you can attend the H1B visa interview again. Any employer can file a new H1B petition using the CAP from the previous petition.

    Also, how soon a visa can be filed again after rejection.
