New H1 after old H1 expired

Hi,

My wife had a valid H1 petition that expired in Oct 2011. The employer who files the H1 earlier told me that they can file a new H1 but the new H1 will not be counted under 2013 quota...Is that true?

Her previous H1 has already expired, can they file for a cap exempt H1 using the old EAC#?
