  • Cap Exempt H1B with Non-profit

    I am presently in US on a B2. I am trying to apply for a Cap Exempt H1B in a University. My questions are :
    1. Are non-profits/Universities hiring H1Bs?
    2. How long would it take to process the Visa.
    3. Will I need to go back to my host country for COS

    Will be glad to hear your experiences..

    >>> That is something that you need to figure out. If the question is about whether they are allowed to hire H1Bs, then the answer is YES.

    2. How long would it take to process the Visa.
    >>> 2-3 months by normal process and 15 days by premium.

    3. Will I need to go back to my host country for COS
    >>> If it is a COS, then there is no need to go back to your home country as the COS will come with a new I-94. If it gets approved for consular process, then you need to go back to your home country to get the visa stamped.

      I need COS from B1 to Cap-exempt H1B. Will it require me to go back to my country?

        The h1B gets approved as a COS (with a new I-94), then there is no need to leave U.S. It is not advisbale to file a COS from B1/B2 to H1B. You may end up facing a lot of questions when you attend the visa interview in the future.
