  • H1b beyond 6 years

    Hi All,

    Here is my case.
    - Got H1B in oct 2005.
    - Came to US on it in Jan 2006.
    - Lived in US physically for 4 yrs 8 months (excluding vacations) until Nov 2010
    - Went back to India in Dec 2010 and lived there for 16 months.
    - Applied for H1B renewal in Jan 2012 and got it renewed for 15 months. (Mar 2012 to Jun 2013)
    - Came back to US in May 2012 on this renewed H1B and staying here..

I want to know whether I can renew my H1B again while staying in US or do I need to go back to India on my visa expiration in Jun 2013? In the latter case how long do I need to wait before I can apply for a new H1B.

    Thanks.

You will have to leave the country and stay outside for 1 whole year to be eligible for a fresh new 6 years on H1B (Assuming you don't have the GC process started).
