My wife who in on H4 right now filed for a new H1 for 2013 with two separate vendors. She filed with one vendor and gave all the documents but when they started asking for signing a contract, she said "NO". Still, they went ahead and filed the H1 for her. They did not even attach the "Education evaluation" and said that we are aware that there will be a RFE but we want to get counted in the quota first.
Meanwhile, another vendor which was good filed the H1 in proper way and the H1 was counted in the quota at the last moment and EAC number generated. Now, the question is
1) Will filing with two different vendors be a issue ? If yes, what will it be ?
2) Do we have to request the first vendor to file for a cancellation ?
3) Do we have communicate this duplicate filing to the second vendor.
Also, for stamping, if we go to Mexico or Canada before Oct 1st, and the H1 stamping is rejected, what will happen ?
