  • H1B Transfer RFE status

    I am working on H-1B Visa with Company A and have applied for H-1B Transfer to Company B. I have an H-1B Transfer receipt of my H-1B Transfer filing with Company B. But it is in RFE (Request for evidence) status. Is it a good idea to go with Company B or i have to stay with Company A.

    You are allowed to work for Company B once you have received the receipt notice. But if the transfer get denied, then you will be in trouble. It is advisable that you join the new employer only after a successful transfer.

      I informed company B about this situtation i.e. if the petition get denied i have to leave US if i come under your payroll. But company B said they will file a case with USICS against the vias transfer deniel. Is it possible for them do to like this. Can i stay in US during that period after my deniel.
