L1B visa expiring, I94 and EAD valid, apply for COS

  • L1B visa expiring, I94 and EAD valid, apply for COS

    Hi all,

    I and my wife have these details regarding to our visas now :

    1. My L1B visa valid till : Aug 2012
    2. My Wife L2 visa valid till : Sept 2012
    3. My I94 valid till : June 2015
    4. My wife I94 valid till : June 2015
    5. My Wife EAD valid till : June 2014

    I and my wife are currently working for the same company (Company X) (Me on L1B and my wife on EAD). The company X has applied for H1B COS for both of us.

    I have following questions :
    1. Can I and my wife continue working even after our visas expire.
    2. If our H1B gets rejected , can we still continue work on valid I94s and valid EAD.
    3. If H1B COS gets approved, can we continue working till October 2012 on our current status and then work on approved H1B status.

    1. Yes. You can work till your I-94 is valid and your wife can work till her EAD is valid.
    2. Yes.
    3. Yes. After 01 Oct you should work only on H1. When you leave US and want to return you would both have to get individual H1 stamped in passport and re-enter.
