  • US Tourist Visa B2 Extension

    Hi,

My sister in law is 20 yrs old & has little retarded intelligence. She went for US tourist B2 visa interview with my in-laws last year and got the visa just for 1 yr. However, my in-laws got for 10 years. We are planning to get them to US next year for tourism. So, if some once could please answer the following questions and help

    1. What is the renewal process for her B2 visa?
    2. Can some one escort her for the visa interview process as she needs some assistance to answer all the questions.

Thanks in advance for all your help.

First of all her Visa only needs to be valid on the day of travel to US, if that is the case she does not need new Visa. Visa validity has nothing to do with duration of stay.

Secondly, she can be assisted as being disabled. She may even qualify for interview waiver based on her recently expired Visa.
This is my opinion and not legal advice.

Thank you so much for your reply.
Her visa is expiring on 31st of Mar 13 and the travel plans is some time in Feb 13. In that case how lonog her stay can be ? I mean I 94 depends on the remaining days on her visa validity or it dependes on the immigration officer.

What is the process to interview waiver for her visa renewal process and what documentation we need to support her retarded inteligence. One more question how early we can start her visa renewal process. Can we start before the visa expires?

      Thanks,
      Vineet

Duration of stay (I-94) has nothing to do with Visa expiry.

You can find information about interview waiver on VFS website.

So, she can travel any time before her visa expires. But how her stay on I 94 will be decided. We are planning for 4 months of stay for her and the parents.

I will look for visa waiver process on VFS's website.

          Thanks,

I-94 is determined by what she asks for and what the CBP officer deems appropriate. 6 months is the maximum and that much is given by default, but it is not guaranteed.
