  • Partly used & expired H1B - transfer

    My H1B expired in 2004(partly used). I was in US on L1 for a year plus and back to India now. Have a US job offer in hand.
    I understand it is possible to transfer the old H1B even though it is expired. The employer who gave the offer to me is not much
    interested in sorting out my H1B transfer problems. What all documentation would I need from them to transfer my H1B and how
    long will it take?. Please advise.

    There are several threads about this topic. Expired H1B can be salvaged upto 6 years from the date of first petition approval.
    For ex: If your initial H1B petition was approved on Sep-1-2006 and you havent used the full time on the H1B, the latest you can apply for a transfer is by 31st Aug 2012(earlier the better)
    You do the math in your case and also consult an immigration attorney.
