Good Morning,
I am in the USA on an E2 Investor visa.
When I came over in February, I had been separated from my wife of 20 years for about 18 months. Divorce had started but never completed. We have decided to give it another go, fresh start etc. When applying to the courts for the marriage certificate to be sent back we were told it could take up to 12 weeks.
So my question is this: Can she come here on her ESTA until we get the marriage certificate, (obviously within the confines of the 90 day allowance), and then apply for the E2 Spouse Visa and have the interview in the USA? Or would she have to return to London to do so?
