  • I-94 extension with E-2 Visa

    Hello,

    I have question concerning the I-94. I have a E-2 Visa with the company I am working for in the U.S. I brought my wife and daughter with as dependents. Our Visas are good until Oct-05-2022. The I-94's expire on Oct-15-2019. The attorney that works with the company is telling us that we just need to exit the U.S. and re-enter and the I-94"s will be extended. Is this correct or does the company I work for need to file a I-129 & I-539.

    You can leave and re-enter to be admitted for a new stay. You do not need an I-129 petition if you do that. Or your employer can file I-129 for Extension of Status in the US without leaving.
