I have seen a few things on the internet about L1B -> GC transitions for same-nationality couples/families, but my husband and I come from different countries so I wanted to know if this would change our process.
These are our details -
Husband: British citizen. He has been working in the US on L1B for roughly 12 months, and this past year is his first time living in the US. His company is a US-based multi-national company that qualifies for L1 blanket petitions. He has a UK master's degree, and has been in the same role for his current company in various locations around the world for 6 years now, so let's assume he qualifies for EB2.
Wife: Japanese citizen. Currently in the US on L2 for roughly 2 months now, awaiting EAD. Grew up moving in and out between US and Japan, altogether have spent total of 10 years in US (visas previously held were E2, J1, F1). Have US Bachelor's degree, no advanced degree.
The points I am interested in knowing are:
(1) how early we can start applying for GC - can we ask company to start filing on our behalf already?
(2) approximately how long the process would take for both of us to get GCs, particularly taking into account our different nationalities and the fact that wife has been in and out of the US many times (legally at all times) under various visas
(3) how the L2's EAD would be affected during the switch-over/petitioning process from L2 to GC. Also, if we start filing for a GC, must I get a different EAD other than the one that I've applied for under the L2?
